Minnesota Senator Amy Klobuchar Wants to Put Justin Bieber in Jail

Straight from the music and movie industry lobbyists, across Amy Klobuchar’s desk, and now pending before the Senate, Amy Klobuchar wants to put people in jail for posting a video of a performance of copyrighted material (i.e., that video of you singing “My Sharona” in the shower). Like how one of the biggest artists on the planet (Justin Bieber—ask your kid) got his start:

Hey, it’s not my thing, but I want this kind of video to exist; it’s this kind of thing that makes the Internat great. Amy Klobuchar wants to kill it.

Klobuchar says the bill would only apply to people who make money from posting performances of copyrighted material. Not so. The bill covers any video that is played 10 or more times, if the copyright owner says the value of those “performances” exceeds $2,500 or if the “fair market value” of a license to perform the material exceeds $5,000. Given what filesharing cases are going for these days, that shouldn’t be hard to allege. And who knows what YouTube makes off those ads it shows next to your video, anyway. Any guess what 36 million+ views is worth? That’s what the above video has gotten.

To be fair, she’s just making a bad law worse. But it’s quite likely she’s doing so at the behest of the music and movie industry. If so, she’s sold out, and no matter what the bill says, that means it’s time for her to go. Sellouts don’t belong in Congress.

Edit: More felons.

(Thanks, Anne!)

Well all I am going to say is that after some time I realize that Justin is a good kid at heart. And after seeing the issue with Mariah Yeater and all those lawyer attacking Justin like the way they did made me realize that the justice system is not about justice but about the mis use of its ethics to get what the law makers want out of their innocent victims like Justin. So from the legal point as in regards to s.978 I am going say this Justin was used as a pawn to manipulate the actual truth as in regards to the fact about s.978. Justin is not the issue the radio station hot 99.5 is and you all are. You are just coaching Justin to believe that this law will put him in jail and exploiting Justins innocense to distort the truth! The law protects the rights of the copyrights of musicians and artists that value their work. And any mis use of other peoples copyrights is a felony and not that of personal video’s. So stop manipulating Justin’s innocense to exploit others to believe in your unethical views about this law!

  • Chitrita Dumire

Oh I also told Lori Swanson about what you called me! I believe that your mental capicity is that of a sixteen year old or Justin must have paid you good to say what you are saying! A real true lawyer would not speak the way you did! But I don’t have to take that kind of studpidity from any one and especially from a lawyer that is going to stoop so low as to believe a sixteen year old!

  • Chitrita Dumire

O.k but before I go I called Amy Klobuchar and also Lor Swanson in regards to your slander against your own states senator. I wonder where did you say you got your law degree at? If you believe 16 year old and continue slander others even your own senator than that is not really saying much in regards to your credibility. I am not stupid and I did understand the bill. I just don’t think that you did or else you got your degree from K-Mart!

    • Mary

Chitrita – since you were able to find Sam’s phone # you clearly found it on his company’s website. The same place that that also clearly shows his education and background. Way to go by insulting someone who actually knows what they are talking about – you know a REAL lawyer not a wanna be criminal justice student taking an associate degree correspondence class. But the nitwit newbie to criminal justice and clearly a failure at private investigation you were apparently not able to ascertain this from his website. Let me help you out here:

He received his JD (Juris Doctorate) degree from The University of Minnesota Law School, in 2003. This degree is required to practice law and I’m sure the University of Minnesota would be impressed that you are comparing them to Kmart. Had you done a bit more research you would have found he is a member of good standing in the Minnesota State Bar Association.

He has worked at the Office of the US. Public Defender in Federal Criminal appellate litigation. Who knows, you may need someone like him after lying and slandering the US Secret Service on Rip-Off Reports.

Yep, it is official – you ARE a Troll.

  • Chitrita Dumire

Well you believe what you believe and I will stay with what I believe! And I think that this would end our discussion! Thank you!

    • Sam Glover

It’s really not a matter of belief. The bill says what it says; it just doesn’t say what you seem to think it does.

      Also, please stop calling me.

  • Chitrita Dumire

Sorry Felony. My mistake. Take care.

  • Chitrita Dumire

Oh I forgot! I did read the bill and I do know what the word FELLONY means! But the bill does not apply to what you are saying. It is only for industries like big movie or music companies like Tri-Star an it still does not aply to personal use. The word fellony is their however you probably along with many others misunderstood. It is just like when a big student loan guarantor Educational Credit Management Corp. had wrongfully offset my federal income taxes this year without abiding by the offeset treasury law. And your Attorney General Lori Swanson caught that. That is the same as the law s.978 it is only meant for big companies that misuse the privilages of the rules and regulations and not for personal use like ECMC was trying to do with my taxes, they were embezzling from me and that would mean a fellony and that is what Amy is meaning with the word useage of Fellony and not on a personal level.

    • Sam Glover

No, that’s not it at all.

    • Jessica

So uh – Chitrita, you know what the word “Fellony” means but you cant’ spell it? Just so you know it is actually spelled Felony. Somehow I’m not convinced you know what the word means much less the legal ramifications of this piece of legislation that was being introduced by Amy Klobauchar. Sam is absolutely correct in his interpretation and his concerns – about both this bil and you.

  • Chitrita Dumire

Oh and I am not a communist by any means! I am a democrate and always have been!

  • Chitrita Dumire

O.k. so maybe I need to study the bill some more. Thank you.

  • Chitrita Dumire

Second line the word is (professional) sorry about the error. Thank you.

  • Chitrita Dumire

The purpose of this legislation for s.978 is not to go after your friends and family who try to enjoy and recreate the music they love. The bill is an effort to go after those who try and use the frofessional work of the music industry unfairly and are trying to make money off of these unfair practices. In another words steeling other people’s copyrights and whithout their knowledge selling it and illegaly without the original music industries permission has nothing to do with Justin Bieber puting up personal vedio’s. Pleae read the bill before judging negatively. htt://blog.copyrightalliance…….-campain/ Thank You.

    • Sam Glover

You may be right about the purpose of the bill, but that is not what the bill says. The bill would make it a felony for anyone to post a video of themselves singing along with a song. It doesn’t matter if they sell the video. It doesn’t matter if they make money off the video. It’s a felony either way. (Felony equals jail time, by the way.)

I also think the bill runs roughshod over fair use, since such activity would ordinarily fall comfortably within the fair use exception.

I’ve read the bill. I can’t believe you have, because you seem to have no idea what it says.

(Your link doesn’t work, by the way, but the Copyright Alliance is a heavily biased special interest group. It’s not a trustworthy source of information about copyright issues—by a long shot.)

  • IndyCindy

Maybe I missed something but I found this directly from the S.978 — To amend the criminal penalty provision for criminal infringement of a copyright, and for other purposes. (Reported in Senate – RS) on more than 1 site….

shall be imprisoned not more than 5 years, fined in the amount set forth in this title, or both, if–
    I thought imprisoned ment jail?
And I agree with Sam-very Bad Idea-Freedom of Speech and a democrate society not a communist America.

    • Sam Glover

No, silly, you don’t get it. Imprisoned means “making sure that everyone’s rights are protected.”

      • IndyCindy

ohhhhhh, silly me and I did read it (the Bill), but in English and I did not see any exceptions like if you are only big corporations and not a 12 year old and if you didn’t ‘really’ mean to…seriously, get a clue people. Bills are to create laws that law enforcement is to follow as it is stated, not by what some one ‘thinks’ it is supposed to mean. If the Bill is intended to exclude or only mean a specific group of people or corporations, then it needs to state that.

  • Chitrita Dumire

I am sorry for my english and my spelling in not so good but getting better. So I am just urging that you study this law a bit more and get a fuller and more complete understanding of this law before you slander it. That was all my point I was trying to make.

  • Chitrita Dumire

No I am not a computer troll. I never do any thing deliberately. Now I know who you are a typical lawyer. And my point was only to speak out that was all. And for your information I do have dealings with that state. Its a company by the name of Educational Credit Management Corp. owned and operated by Richard J. Boyle. My student loans were by that company but they were giving me a lot of trouble. But your state Attorney General Lori Swanson had helped me out to settle the debt and now the loan is with Direct Loans or with the Feds. So technically now I am owned by the federal gevernement thank to Lori Swanson. Since I had appreciated her help I decided to help your state back. So when I heard about this law that Amy Klobaucher and Senator Chris Coon is trying to pass I got involved in helping them pass this law. I had to study this law first before I said anything so that is what I set out to do. It took me a month to really study this law. So I did. And for your information I really am a Criminal Justice Student and since I owe this student loan debt to the government I have taken also the liberty to help support the government in any government related issues and also help in the side with any other crime for free as I don’t have my degree yet I plan to complet my masters in 2015 sometimes. I am from India Kolkata. Been here in the states for over 30 years. I am 48 years old maried for 10 years. Have three step kids and five grand kids. And the rest of my family is all over the world and even some wher Justine Bieber is from Canada. I was just a bit upset as to why this kid would oppos to this law and slander a government official whom has no intension of may him or any one go to jail. I also help all type off government related issues even terrorism. But I work for free because I am owned by them. I do pay my loan and as a service I continue this work to make sure that everyones rights are protected. However, I will respect your request to leave you a lone. So now you know that I am not a computer troll but some one that serves the government in all area’s of crime. Thank you anyway for allowing me to speak.

  • http://caveatemptorblog.com Sam Glover

Wow, way to escalate by calling me! Not to mention 10 out of the 12 comments on this post are yours.

A troll in internet parlance is someone who is deliberately provocative in blog comments, forums, etc. Sometimes, trolls do this by making ridiculous comments. That’s why I took you for a troll. I wasn’t calling you an ugly mythical beast.

From your phone call, I am convinced that you are either (a) not a troll, or (b) a highly skilled troll. The former seems more likely, and so I am sorry for calling you a troll. Unless you are one, in which case you’ve got me. Good for you.

However, maybe you should stop commenting now.

  • Chitrita Dumire

Also since we are all protected by the freedom of speach act I know what is going on with this exactly, so that is why I stepped up to the plate to protect the law and the rights of the people that made the law and wanted the law. Bieber doesn’t want the law because it puts restriction on his streaming his music vedio’s on facebook, myspace, and the like so he is getting as much leverage as he can to oppose the restriction. The law does restriction his music venture but it won’t put him in jail as long as he and others that are opposition to this law abides by the rules and regulations that may put some restrictions on the excessive streaming and I do agree with that and that it will protect the copyrights of those whose wishes to protect the originality of their work without other pirates from taking over thus which will allow these pirates to control other peoples copyrights and that would make it illegal. As long as Bieber abides by this law and the restriction and ruels and regaulations that go along with it there is no reason where he is going to go to jail. Anything excessive that may hinder the protections of other peoples work is illegal bottom line!!! He or you can cry like a baby all you want but the point is all the law is doing is regulating him and that is why he is crying the blues, but it won’t put him in jail as long as the restrictions are followed and that is for everyones good bottom line and has nothing to do with anyone having to go to prison as long as they abide by those restrictions BOTTOM LINE AND END OF THIS DISCUSSION!! ANY OTHER SPECIFICS NEED TO BE PROPERLY ADDRESSED WITH AMY KLOBACHUAR! And any amount of slander to her or any congress or member of the government will be reported to appropriate authorities to be dealt with!

  • Chitrita Dumire

And also I will report you to this company and file charges against this company!

  • Chitrita Dumire

The word on the third line is remark. So before you judge think! And if you are just following a 16 year old than think on that too because than you are not so much an adult but a 16 year old because the way you are writing and talking it would seem that you want to impress a 16 year old. Well I follow my own and I don’t follow any one else’s ignorance! So the next time you call me any name or slander this bill than I will reprot your writing skills to the appropriate authorities! The Law is my business and so is protecting the rights of others! And I will continue to do so regardless of your ignorance! Oh by the way I am also a private Criminal Justice Investigator!

  • Chitrita Dumire

Another message to all that are in opposition to Amy Klobauchar’s bill S.978. If you are in opposition to the bill than please contact your legislation and discus the situation in a way that is not harming anyone! Like name calling or giving a smart remakr especially the one that was made to me by Sam Glover. If you are a report or a writer your standards really need to imporove and if name calling and inappropriate remarkes continue to slander the bill and anyone that believes in it I will have to report the issue to appropriate authorities. In another words you are a grown adult I would assume. Act like one. And if you are following a 16 year old that doesn’t comprehend what the purpose of this bill is for than your mental capicity is just that of a 16 year old!

  • Chitrita Dumire

If I am so be it! But the bill is going to be! And any slander against anyone and any ill thought are just that! The bill stands for set standars protecting peopls rights and that is the end of the story! And all that name calling is all that is! When people don’t understand that is what they do! They call people names! But if that is what makes you all happy so be it! But the bill will go through and that won’t change!

  • http://caveatemptorblog.com Sam Glover

You must be a troll. Anyone who so much as glances at the bill would see that the explicit intent is to put people in prison. It doesn’t have anything to do with God, either.

  • Chitrita Dumire

Another thing I want to add especially to Justin that he does have a good talent but he is young and really needs to learn to talk to his elders with more respect especially to the officials of the governemt. I am speaking out to him this way because I know that I may never meet him in person. All I am trying to say is that he just needs to make good choices in his life. He loves music and that is a good thing. And more than any thing I don’t want to hurt him but only wish him well and with his business. The law will not take that away from him and won’t take anything away from his fan’s either. I hve listened to many of his music and very impressed with his talent at such a young age. However, my feelings are still strong about this law to pass. And this is my message to you all from my heart that anger is not the way to see things. Only the light can guide us teach us and give us inspiration and hope. So that is what I leave you all with my sprit of hope and love and respect and knowledge. I may never see Justine nor he may never see me but my spirt will always be with you all. Thank you for giving me a chance to share my thoughts. You will never hear or see of me again. It is only through the spirit of God that I was guided to follow this law and that is where I leave you all! Peace!

  • Chitrita Dumire

Oh another eror on the second sentence to make it a clear point no one is going to jail but the law is going through.

  • Chitrita Dumire

I might have made a slight eror the word on the first sentence is adjust.

  • Chitrita Dumire

I think you need to adust your knowledge about the law before you make alligation on a subject that you are not clear of. No has said that any one is going to jail. You just all are saying that just to put a wrong controversy on this bill. And I am not buying any of it. I believe in this law like people believe in God and I believe he has a purpose for this law. It is his will that governs not ours. This law protect the copyrigths and people that want that has a right to want their copyrights to be protect. Amy Klobauchar never mentioned anyone going to jail! So before you decide to put any alligations on this law you must have concrete proof. The law is going through. So I wellcome any critisisim of this ignorance that everyone is trying to put against a law that I feel will do a lot of good. So go ahead and put up your video’s. If no one come to cuff you than I will think that you would only give a benefit of a doubt rather than puting a guilt trip on this law. Not unless you all have some to admit as to why this law should not be passing. But regardless of opinions this law will pass and no one will go to jail especially not Justin Bieber. I belive that there should be certain ruels and regulations and restrictions to follow and that is only for everyones own good. So no amount of alligations towards this law is going harness any change in my feelings about the law. It will pass. Nothing else is going to change expect I hope that people ignorance about this law will! GOD always has a plan and a purpose for every thing. And I am just his assistance to make sure that his plan does not faulter and I don’t think it will!

  • Chitrita Dumire

I personally think that she is doing everyone a favour by protecting the copyrights of everyones personal work from the invasions of priates that could do more financial damage than you think. I am a Criminal Justice student masters degree programe online Ashworth University Norcross, GA. I myself signed for the bill to pass for the President to sign. And I think it possiblly will. So it is not about congress or music but about everyone’s rights to be protected! So those that want the bill is entiled to that and no one has the right to say otherwise as each opinion is a personal issue and not a political nor a criminal act but rather a decision based on protecting peoples rights! So I feel that everyone needs to take a good look at the bill before any negative comment is made! Knowledge is power!

    • Sam Glover

You’re probably right. Uploading a video of yourself singing along to your favorite song should definitely get you tossed in jail for a few years.

      • static

This is a fascinating post and comments. I will bookmark it for future reference.
